The family of a Maricopa County judge has filed suit seeking damages for her death after being hit by a car in a Phoenix intersection last year.

Rosa Mroz, the first Asian-American woman to serve as a Maricopa County Superior Court judge, died days after she was struck by a Grubhub driver near 56th Street and Camelback Road in Phoenix.

The suit alleges that the driver ran a red light while looking at his phone to complete an order.

The U.S. Department of Transportation says about 8% of fatal crashes involve distracted driving.

Mroz headed the court’s Probate and Mental Health Department from 2010 to 2013.

The Arizona Supreme Court in 2012 presented Mroz with a judicial achievement award and the Probate and Mental Health Department in 2013 won achievement awards from the National Association of Court Management and the National Association of Counties.
